Because according to the themeforest website, it is only compatible with the 3.8-version.
If not, when will it be so?

If you view the first part of the description, there is a huge “banner” saying it’s WP 3.9 compatible.

All our themes are WP 3.9 compatible and they were even compatible a few days before the official WordPress 3.9 version got released

Thank you though for noticing the faulty information. It usually takes ThemeForest a few days after the official WordPress version is out to add the 3.9 option to their settings and this is the reason it is still not there, but we will fix it.
